SMS Lead Notifications: terms and privacy

These terms and this privacy notice cover the text messages that ApiWay, Inc. (“Apiway”) sends in its Lead Notifications program. They add to our Terms of Use and Privacy Policy. For these text messages, where this page is more specific, this page applies; for everything else, the Terms of Use and the Privacy Policy apply.

The program

Program name: Apiway Lead Notifications. Operated by: ApiWay, Inc., Suite S2, 1050 North Third Street, Laramie, Wyoming 82072, USA.

Lead Transfer is an Apiway app. A customer connects the lead forms of its own advertising or website (for example a Facebook or TikTok lead form) and chooses where each new form submission goes. One of the choices is a text message to the customer’s own mobile phone. When a new submission arrives, Apiway sends one text message with its details to the number the customer entered, so the customer can answer the enquiry quickly.

  • The messages go only to the number the customer entered as their own. The program does not send messages to the people who fill in the form, and entering another person’s number without their permission breaks these terms.
  • The messages are service notifications about the customer’s own account. They contain no advertising, no offers and no links.
  • Apiway is a service provider. It does not generate, buy, sell or rent leads. The form submissions come from the customer’s own forms and belong to that customer. Apiway moves them only where the customer’s own automation settings send them, keeps them only to run the service for the customer (for example the delivery history in Lead Transfer), and does not use them for its own purposes or give them to anyone else.
  • The wording of the messages is fixed by Apiway. A customer chooses only the number and which answers from the form are included; a customer cannot write or send any other text through this program.

A notification looks like this:

Apiway lead: Spring Offer Jane Doe jane@example.com +15550100100 budget: 5000 Reply STOP to opt out.

Every message starts with “Apiway lead:”. The first message after you agree ends with “Reply STOP to opt out.”; later messages leave this line out to stay short.

How you agree to receive the messages

You opt in yourself, inside your Apiway account. There is no other way to start these messages, and no keyword starts them.

  1. Sign in to Apiway. These messages are available only on a paid plan.
  2. Open Lead Transfer and create an automation.
  3. In “Step 2. Set up destination”, choose the action app “SMS”.
  4. Type your own mobile number, with the country code, in “Your mobile number”.
  5. Tick the box that says, word for word:☐ I agree to receive text messages from Apiway at this number: one message for each new lead of this automation. Message and data rates may apply. Reply HELP for help, STOP to opt out. SMS terms and privacyThe box is not ticked in advance. “SMS terms and privacy” links to this page.
  6. Turn the automation on. Messages start only after this step.

The agreement is for that one number. If you change the number, the box is cleared and you must tick it again. We record when you ticked it, for which number, and which wording you agreed to. Agreeing to these messages is not a condition of any purchase.

By ticking the box you also accept these SMS terms for the program. Apiway’s chat assistant can prepare such an automation for you, but it cannot tick the box: an SMS automation stays off until you tick it yourself.

Message frequency

One text message for each new form submission that reaches the automation. How many you receive depends on how many submissions your forms get. Besides these, you receive a test message only when you press “Test automation”, and the automatic replies to STOP and HELP. Apiway sends no other texts to this number through this program.

What it costs

  • Message and data rates may apply. Your mobile carrier may charge you for messages you receive, under your own mobile plan. Apiway does not set, control or refund those charges.
  • Apiway charges your Apiway account for each message, in credits or data transfers, as shown under the message preview in Lead Transfer and on its pricing tab. The price depends on the country of the number and on the length of the message.
  • A message is charged when Apiway hands it to the messaging provider. If the provider refuses it, the charge is returned automatically. Mobile carriers deliver the messages, and delivery is not guaranteed; see Terms of Use §7.9–7.10 and §18.

Opt out and help

  • To stop the messages, reply STOP to any message. You receive one confirmation, and then no more texts from this program to that number. You can also turn the automation off or delete it in Lead Transfer.
  • After you reply STOP, the number stays blocked until you reply START from that phone. Turning the automation off and on again does not lift the block.
  • For help, reply HELP to any message, or write to info@apiway.ai. We aim to answer within two business days.

Your responsibilities

  • Enter only a number that is yours, or that you are authorized to use and whose user agreed to receive these messages.
  • Use the program only to receive submissions of your own forms. You must have the right to collect the data in them, as the Terms of Use §17 and the Privacy Policy §2.5 describe.
  • Apiway sends these messages on the settings you chose; they are your automation’s actions (Terms of Use §6A). Apiway may pause or turn off the program for an account, for example when a carrier flags the traffic or the rules on this page are broken (§4.3, §17.7).

Delivery and liability

Carriers are not liable for delayed or undelivered messages. A message can be delayed or blocked by a carrier, and a phone that is off or out of coverage may not receive it. Do not rely on a text message as the only way to learn about a lead: every lead also stays in your Apiway account. Apiway’s liability is set by Terms of Use §8 and §9.

Privacy: your mobile number and the lead details

What we collect. The mobile number you enter; the record of your agreement (when, for which number, and which wording); the lead details that went into each message, and whether the provider accepted it.

How we use it. Only to send these messages, to bill them, to answer HELP and honor STOP, to prevent abuse, and to support you.

We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are never sold or shared for anyone’s marketing.

Who delivers the messages. To send a message, Apiway passes the number and the message text to its messaging provider, Twilio Inc., which processes them as our service provider under its data protection terms; the mobile carriers handle the message to deliver it. Our providers are listed on the Subprocessors page.

The lead details. The form answers in a message are data of the people who filled in your form. You control that data and Apiway processes it for you (Privacy Policy §2.5, §17.5).

How long we keep it. The number and the record of your agreement are kept with the automation, also after you switch it off or remove it, for as long as the Privacy Policy §7 keeps Lead transfer data, so the agreement can be shown when it is asked for. The same applies to the lead data and the delivery log. To ask about your data or to have it deleted, write to info@apiway.ai or see How to delete your data.
