Mailerlite list subscription via Woocommerce

Hi everyone, a question: I have a Woocommerce webshop, on the checkout page the customers can subscribe to a Mailerlite newsletter. I also have a digital product which is linked to an automation in Mailerlite (everybody who buys the product should get the automation emails). Now it seems that the customer needs to check the checkbox on the checkout page too for the automation to work. What am I missing? (I'd like to make it work without checking the checkbox.) Thanks for any ideas.
